– A California Appellate Court judge, fearing an onslaught of lawsuits following the court’s ruling in late June that insurers can be sued for violations of the state’s Insurance Code section 758.5, which prohibits insurers from suggesting the use of a specific repair shop unless the insured asks for a referral or is informed in writing of his or her right to select a shop of their choice.
